Recovery of NHS Charges in PI Claims - Quantum

Repayment of NHS Charges in Personal Injury Claims

Overview

Claimants in personal injury claims may have received hospital treatment or taken ambulance journeys as a result of their injuries.

When a successful claim is made the Defendant has to pay for the cost of any National Health Service treatment.

This e-learning course provides an introduction to the repayment of NHS charges. It is an ideal introduction for anyone who has recently started work in the personal injury sector.

Outcomes

As part of The Health and Social Care (Community Health and Standards) Act 2003, a compensator is liable to repay NHS treatment charges if they make a compensation settlement.

Specifically they must make a payment to the NHS if the accident resulted in an injured person utilising an NHS ambulance service and/or receiving medical treatment at an NHS hospital.

This training provides an overview of NHS charges and covers:

  • When a Defendant is liable to repay NHS charges
  • How NHS charges are calculated
  • The procedure governing repayment of NHS charges
  • How to approach complex cases
    • Multiple compensators
    • Contributory negligence
    • Fatal accidents
