This detriment to a claimant's earning potential is different and separate to any loss of earnings which has already been incurred following an accident. Assessing damages for loss of earning capacity can be a complicated task. It requires consideration of the level of earnings a claimant could have reasonably expected if the injury never occurred along with any disadvantages on the labour market.
